Andrew Pashinin, a 20-year-old resident of Harrison, will serve three and a half years in prison for shoving a stranger onto subway tracks in Brooklyn. The sentence was handed down in Brooklyn Supreme Court, concluding a case that began with a violent confrontation on a crowded platform.
The incident occurred on December 7, 2024, at approximately 11:35 a.m. on the southbound D train platform at the Atlantic Avenue-Barclays station. Pashinin approached a 33-year-old man standing on the platform. He first pulled out a knife, then stowed it and retrieved a camera to record the victim.
An argument broke out between the two men. The victim turned to walk away, but Pashinin followed and shoved him from behind. The force of the push sent the victim onto the subway tracks. He managed to climb back onto the platform seconds before a train entered the station.
Pashinin fled the scene immediately after the shoving. Police arrested him on January 21, 2025, following an investigation into the incident. A jury in Brooklyn found him guilty on August 24, 2026, of first-degree attempted assault and fourth-degree criminal possession of a weapon.
Brooklyn District Attorney Eric Gonzalez addressed the sentencing in a statement. "It is every New Yorker's worst fear to be senselessly shoved without warning onto the subway tracks," Gonzalez said. He noted that the sentence holds the defendant accountable for the act. Gonzalez also stated, "Thankfully, the victim in this case was able to safely get off the tracks just before a train entered the station."
In addition to the prison term, Pashinin received two years of post-release supervision. The court ruled that the sentence reflects the severity of the attempted assault and the weapon possession charges. The victim was released from the hospital without life-threatening injuries, though the source does not specify the extent of his physical harm.
The case highlights the consequences of the violent encounter that unfolded during the midday rush hour. Pashinin’s legal team did not file an appeal before the sentencing was finalized. He is now scheduled to report to a correctional facility to begin his term of imprisonment.
